Items are picked up and consigned based on the condition. If we arrive and the pieces are not in the condition described, we will not take them. If we get them to our store and determine there is damage or staining we did not see at your home, we will contact you to come pick them up.

Resort Resale Consignment LLC Agreement
General Conditions: Under the terms of this Consignment Agreement, the Consignor agrees to deliver goods to be sold by the Consignee, referred to in this document as “Resort Resale”. Resort Resale agrees to place consignor’s merchandise in store for sale. Resort Resale will remit 50% of the selling price to the consignor. Acceptance of merchandise for sale is at the discretion of Resort Resale. The Consignment Agreement will remain in effect for all merchandise consigned until a new Consignment Agreement is signed. Consignor understands that while Resort Resale agrees to use its best efforts to obtain a sale of the merchandise, there is no guaranty a sale will occur.
Merchandise Pricing: The initial selling price for consigned merchandise is established by Resort Resale.
In determining the initial selling price, factors such as brand, condition, historical sales data and current market demand will be considered.
Merchandise Receipt: Each time merchandise is consigned, Resort Resale staff will prepare a Merchandise Receipt listing the Consignor’s name, account number, and a detailed list of the items accepted for consignment on that date.
The Consignor is required to review and sign the Merchandise Receipt at the time of consignment. The Consignor’s signature acknowledges that the items listed are accurate and complete and that only the items specifically listed have been accepted for consignment.
It is the sole responsibility of the Consignor to carefully review the Merchandise Receipt for completeness and accuracy before signing. Resort Resale shall not be liable for any claims, losses, or discrepancies resulting from omissions, inaccuracies, errors, or the Consignor’s failure to review and sign the Merchandise Receipt.
If the Consignor wishes to receive a copy of the signed Merchandise Receipt, it is the Consignor’s responsibility to request one at the time of signing.
Consignment Term: The consignment term is 90 days. The consignment term starts on the date an item is logged into Resort Resale’s inventory system. That date can be found on the Merchandise Receipt. Merchandise will be marked down approximately 15% every 30 days within the 90 day consignment term. Markdowns are from the ORIGINAL selling price. Consignors may not pick up unsold merchandise before consignment term expiration date.
Consignment Fees: When Consignor merchandise is purchased by a customer using a credit or debit card for payment, the Consignor will be charged a Credit Card Processing Fee of 3% of the sale price of the item, which will be deducted from Consignor payment. Depending on how the Consignor would like to receive their payments (Check or ACH), a $1.00 check fee or a $2.50 ACH fee will be deducted from the Consignor payment.
Payment to Consignors: Resort Resale offers three options for payment - ACH payment via secure online portal, store credit or a physical check that must be retrieved at the store. It is the responsibility of the consignor to pick up the physical check which will be made available at Resort Resale by the 10th of each month for items sold the previous month. ACH payments for monthly sales will be processed to Consignors no later than the 10th day of the following month to the bank account provided in the Consignor’s SimpleACH payment account. SimpleACH utilizes a secure bank-to-bank payments platform named Dwolla to ensure that your digital transfers are protected and neither the store nor SimpleConsign retains your bank account information. Additionally, ACH payments are considered secure, as they are processed through the Automated Clearing House network, which adheres to strict regulations and security standards set by the National Automated Clearing House Association (NACHA). By leveraging these security measures, SimpleACH provides a reliable and safe platform for electronic fund transfers.
Consignment Term Expiration: It is the responsibility of the Consignor to pick up all unsold merchandise within five (5) days after consignment term expiration, Resort Resale reserves the right to dispose of unsold and unclaimed merchandise by means of donating or re-consign as store-owned inventory 95 days from the consignment date without notice or payment to the Consignor and without liability on the part of Resort Resale. It is the responsibility of the Consignor to track the 90-day consignment term expiration.
Items Lost, Stolen or Damaged: All items consigned will be handled with reasonable care; however, they remain at the Consignor’s risk at all times. Resort Resale Consignment LLC is not liable for any loss, theft, or damage to merchandise, including items collected through Resort Resale’s complimentary pick-up service.
Limitation of Liability: Notwithstanding any other provision of this Agreement, Resort Resale’s total aggregate liability to the Consignor for any and all claims, losses, damages, or expenses arising out of or related to this Agreement—whether in contract, tort (including negligence), or otherwise—shall not exceed five hundred dollars ($500.00).
Disputes: In the event of litigation concerning this agreement, the prevailing party in such litigation shall recover from the other party the prevailing party’s attorney’s fee and costs, including any appeals. Any disputes or claims between the parties arising out of or related to this Agreement shall first be submitted to mediation by the parties to occur in Walton County, Florida.
I have read and understood the terms of the Consignment Agreement and agree to accept the conditions therein as applicable to all items consigned with Resort Resale Consignment LLC.
